If you're experiencing problems with your mortgage servicer — incorrect payment processing, loss mitigation delays, escrow errors, or failure to respond to written requests — you have the right to file a formal complaint.

File with the CFPB

Submit a complaint at consumerfinance.gov/complaint. Select "Mortgage" as the product type. The CFPB will forward your complaint to the servicer, which must respond within 15 days.

Send a Qualified Written Request

Under RESPA § 6, you can send a formal written request to your servicer's designated address. They must acknowledge within 5 business days and resolve within 30. Send via certified mail, return receipt requested.

File a Notice of Error

Under 12 CFR § 1024.35, you can formally notify your servicer of 11 categories of errors. This triggers a 30-business-day investigation requirement and protections against negative credit reporting during the investigation.
